I asked the DCSF a question about what the rules were regarding the appointment of a new principal when an academy is formed, since I was lead to believe that it was an “absolute requirement” that the post of principal was advertised nationally.
He is the response I received from the DCSF:
| Thank you for your e-mail dated 19 February, about setting up an Academy. Information on setting up an Academy can be viewed on the Department's Standards Site: http://www.standards.dfes.gov.uk/academies/?version=1. There is no separate statutory requirement for the appointment of an Academy Principal. Depending on the individual circumstances, TUPE - the Transfer of Undertakings (Protection of Employment) Regulations 2006 (SI 2006/246) - may apply, and in all cases, equalities legislation will apply.
